Payment transactions may be processed by third-party payment providers such as Razorpay. We do not directly store complete payment card or banking information unless explicitly stated.

Unless otherwise stated, fees are non-refundable except where required by applicable law or product-specific refund policies.

5. Intellectual Property

All content, software, code, designs, branding, trademarks, graphics, text, and materials provided by Joahquin are owned by or licensed to Joahquin Technologies Private Limited.

Nothing in these Terms transfers ownership rights to users.

You may not reproduce, distribute, modify, or commercially exploit our intellectual property without prior written permission.

6. User Content

Certain products may allow users to submit content, feedback, data, or materials.

You retain ownership of your content. By submitting content through our services, you grant Joahquin a non-exclusive, worldwide, royalty-free license to use, process, store, and display such content solely for operating, maintaining, and improving our services.

You are responsible for ensuring submitted content does not violate laws or third-party rights.

7. Experimental Features

Joahquin may occasionally release experimental, preview, or beta features.

These features may change, be modified, or be discontinued without notice and may contain bugs, interruptions, incomplete functionality, or unexpected behavior.

8. Third-Party Services

Our services may integrate with or link to third-party platforms, APIs, or tools.

Joahquin is not responsible for third-party content, policies, functionality, or services.

Your use of third-party services remains subject to their respective terms and policies.

9. Disclaimer of Warranties

Services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, Joahquin disclaims warranties regarding availability, reliability, accuracy, fitness for a particular purpose, and error-free operation.

We do not guarantee uninterrupted, secure, or error-free services.

10. Limitation of Liability

To the maximum extent permitted by law, Joahquin Technologies Private Limited and its directors, employees, affiliates, or partners shall not be liable for indirect, incidental, special, consequential, punitive, or similar damages arising from use of our services.

Our total liability shall not exceed the greater of:

• Amounts paid by you to the relevant service during the preceding 12 months; or
• The minimum amount permitted under applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Joahquin Technologies Private Limited from claims, liabilities, damages, losses, and expenses arising from:

• Violation of these Terms
• Misuse of services
• Violation of applicable law
• Infringement of third-party rights

12. Termination

We may suspend or terminate access if we reasonably believe these Terms have been violated or continued use may create risk to users, services, or Joahquin.

Users may stop using services at any time and may request account deletion through Delete Account where supported.

Termination does not affect rights or obligations intended to survive termination.

Sections relating to intellectual property, liability limitations, indemnification, and dispute resolution survive termination.

13. Force Majeure

Joahquin shall not be responsible for delays, interruptions, or failures caused by circumstances beyond reasonable control, including natural disasters, internet outages, cloud infrastructure failures, third-party provider outages, labor disputes, government actions, or similar events.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of courts located in Moradabad, Uttar Pradesh, India.

15. Changes to These Terms

We may periodically update these Terms.

Changes become effective upon publication. Continued use of services after updates constitutes acceptance of revised Terms.
